Transfer Denial and Delay Policy
Understanding Our Transfer Policy
If your firearm transfer is denied or delayed, you have a 30-day window to appeal the decision. During this period, we will securely store your item. After 30 days, a storage fee will apply. If the item remains unclaimed for 90 days, it will be considered abandoned, and prepaid return shipping will be required. Please note that our policy complies with federal and Texas state laws.
30 Day Pickup Window:
Customers must retrieve transfers within 30 days of delivery to our shop.
Storage Fees (After 30 Days):

$10/week per item begins on day 31

Fees accumulate until the firearm/NFA item is claimed or disposed
Unclaimed Transfers (After 90 Days):

Items not claimed within 90 days are considered abandoned

At that point, we reserve the right to return it to the sender, or dispose of it (e.g. destroy if required, or sell through ATF-compliant auction)

Return shipping to the sender is the shipper’s responsibility—item will only ship if a prepaid label is provided . There is a fee of 60 in additional to any shipping fees.

Can I transfer a handgun if I live out of state?
No, federal law requires that handguns and receivers must be transferred to an FFL in your home state. We can assist with the transfer process to ensure compliance.
What identification do I need for a transfer?
You will need a valid Texas ID or residency documents to complete a transfer. Ensure all documents are current and match the information on your transfer paperwork.
Do you accept shipments from individuals?
Yes, we accept shipments from private individuals. Please ensure that all packages include a copy of the sender’s ID and contact information for a smooth transfer process.
Who is responsible for return shipping costs?
The customer is responsible for any return shipping costs if a transfer is denied or if an item is not picked up within the specified time frame. Prepaid shipping arrangements must be made and there is a 30 dollar service charge which includes us getting it to UPS or Fedex.
How do I appeal a transfer denial?
If your transfer is denied, you can appeal the decision within 30 days. Contact us for guidance on the appeal process and to ensure your item is securely stored during this period.

Compliance and Storage Disclaimer
Firearm Transfer Non‑Pickup Policy
At Sparks Tactical, we are committed to following all federal and Texas state firearm laws regarding transfers. The following policy applies to all firearms transferred to our store on behalf of a customer:
1. Pickup Deadline

Customers have 30 calendar days from the date the firearm arrives at our store to complete the ATF Form 4473, pass the background check, and take possession of the firearm.

If the transfer is delayed due to a NICS delay, the 30‑day period will be paused until a final NICS determination is received.
2. Failure to Pick Up
If the customer cannot or will not take possession of the firearm within the 30‑day period due to:

Denial from NICS background check

Failure to appear for pickup

Inability to provide required documentation

Any other legal restriction on possession
…then the firearm will be returned to the original seller/shipper (if possible) at the customer’s or sender’s expense.
3. Return Shipping & Fees

The customer or the sending FFL/manufacturer must provide a prepaid return shipping label.

If no prepaid label is provided, we will arrange return shipping and bill the customer or the sending party our actual shipping cost plus a $60 handling fee.

Firearms will not be shipped until all fees are paid in full.
4. Abandonment

Firearms left over 90 days from the arrival date without pickup, payment for return, or other arrangements will be considered abandoned.

Abandoned firearms become the property of Sparks Tactical LLC and will be disposed of in accordance with ATF regulations.
5. Legal Compliance

All transfers will be conducted in accordance with Texas law and ATF regulations.

We will not transfer firearms to any individual who does not pass a background check or who is prohibited from possession under federal or state law.
